Why a Binding Financial Agreement is Essential

A BFA provides a level of certainty that the standard court process cannot guarantee. By entering into an agreement, you can "contract out" of the property division provisions of the Family Law Act 1975, allowing for a predetermined and private resolution of financial affairs.

Frequently Asked Questions

Can a BFA be overturned by the Court?
While a BFA is designed to be final, the Court can set it aside under specific circumstances, such as a failure to disclose assets, evidence of fraud, or if a significant change in circumstances regarding children makes the agreement “unjust.” Our role is to ensure your BFA is as “bulletproof” as possible.
Is a BFA the same as a Pre-Nup?
“Pre-nup” is the common term used in the US, but in Australia, the legal term is a Binding Financial Agreement. They can be signed before, during, or after a marriage or de facto relationship.
Do both parties need their own lawyer?
Yes. It is a strict legal requirement for each person to have their own independent solicitor. This ensures there is no conflict of interest and that both parties fully understand the legal consequences of the contract.
Can we include pet custody in a BFA?
Yes. In 2026, many clients choose to include provisions for “companion animals” to determine who will care for the pet and how expenses will be shared, avoiding future disputes.
